Job Seekers Allowance (JSA)

What is Job Seekers Allowance (JSA)?

Job Seekers Allowance - sometimes referred to as JSA - is the main benefit for people of working age who are out of work or work less than 16 hours a week on average. If you are eligible, it is paid while youre looking for work.

Job Seekers Allowance (JSA) is an allowance that is either "means-tested" or "contribution based" (based on National Insurance payments).

Means-tested JSA is paid for as long as you meet the conditions. It is known as a "passported benefit" as it "passports" a claimant to many other benefits. For example, Job Seekers Allowance (JSA) entitles the claimant to maximum Housing and Council Tax Benefits, free school meals and free prescriptions

Contribution-based Job Seekers Allowance (JSA) is paid for a maximum period of 26 weeks. An unemployed claimant may qualify even if their partner is working or has other income

To date, it is estimated that over £7 billion in benefits goes unclaimed every year - a significant number of which should be claimed by Job Seekers Allowance (JSA) applicants.

Who is eligible for Job Seekers Allowance (JSA)?

If you, or someone you know, are unsure about eligibility for Job Seekers Allowance (JSA), you will need to know the basic qualifying conditions. You must be:-.

  • available for, capable and actively seeking work

  • aged 18 or over but below State Pension age

  • working less than 16 hours per week on average

There are also some other points to bear in mind: -

  • A self-employed person does not qualify for Job Seekers Allowance (JSA) as they do not pay the correct type of National Insurance contributions

  • People who are not eligible for JSA(C) may claim Income-based Job Seekers Allowance (JSA

  • People who are eligible for JSA(C) may also claim JSA(IB) for any additional payments due under that benefit (for family dependents, for example)

  • JSA(IB) is payable only if the claimant has less than £16,000 in savings. Payments are reduced when the person has savings between £6,000 and £16,000.

Case study

Andrew is 46 lives with his partner Jill aged 47. He lost his job ten months ago.

Jill suffers with long term mental health problems and has never been able to work.

She has recently been awarded Disability Living Allowance (DLA); for which she receives a care component and a mobility component (each worth £18.95 per week).

Andrew is claiming Job Seekers Allowance (JSA) income-based. They have no other income or savings.

In this case, Andrew qualifies for a Job Seekers Allowance (JSA) payment of £142.60 per week. This is more than what would normally be paid to a couple (i.e. £102.75 per week). The extra amount is awarded on account of entitlement to Disability Living Allowance.

This case study is fictitious, but helps to illustrate just some of the many ways in which Housing Benefit Helpline can help change peoples lives for the better.

Why does Job Seekers Allowance (JSA) go unclaimed?

Many people who could claim Job Seekers Allowance (JSA) often do not do so.

So why does not everyone claim Job Seekers Allowance (JSA)?

Some of the reasons many people do not claim Job Seekers Allowance (JSA) are as follows:

  • People do not realise that they might be entitled to claim. This often happens when a person is entitled to Job Seekers Allowance (JSA) (contribution based) and does not apply because their spouse or partner continues to work

  • Claim forms can be lengthy and complicated. This can lead to a form being completed incorrectly or, in the worst case, not at all

  • People might put off a claim in the belief that they will find a new job quickly.

What if I have been refused Job Seekers Allowance (JSA)?

Due to the inefficiencies of certain "officials" it has been known for refusals to be over-turned when the claim has been re-presented in a professional and methodical manner (i.e. by a professional company or consultant).

Many times, the refusal decision is based on an incorrect presentation of certain information by the claimant or by an incorrect assessment from the particular benefits office/r in question.

We have found 40% or more of "refused claims" have a very good chance of being overturned.

Needless to say, this issue is very important.

Full claim acceptance not only over-turns a previous refusal, but it also means you will probably be eligible for back-payments from the point of an initial claim.

This alone could often lead to thousands of pounds in back-payments due to you.
